Terms & Conditions
1. Nature of the Commission
House of Ferrera undertakes commissions as an independent cinematic house.
All projects are authored by Ava Ferrera under the House of Ferrera, and are treated as bespoke works of cinematic art. House of Ferrera does not operate as a production service provider, agency, or logistics coordinator.
Each commission is an artistic engagement, not a standard commercial production.
2. Patron-Supported Production
All commissions are supported by the Patron’s own production, travel, accommodation, freight, insurance, and logistical teams.
House of Ferrera does not arrange, advance, or finance any production, travel, or shipping elements.
This ensures the House remains devoted entirely to creative authorship and cinematic integrity.
3. Creative Authority
All artistic, narrative, visual, and editorial decisions rest solely with Ava Ferrera and House of Ferrera.
While Patrons may provide references, intentions, and creative materials, the final cinematic interpretation remains the exclusive artistic domain of the House.
This is essential to preserving the integrity and value of the work.
4. Scope & Delivery
Each commission is defined by a bespoke creative brief and deliverable outline.
House of Ferrera commits to delivering the agreed cinematic works within the timeframe specified in the commission agreement.
Revisions, extensions, or additional deliverables outside the original scope require a new commission.
5. Usage & Rights
Unless otherwise specified in writing:
• The Patron is granted exclusive commercial usage rights to the commissioned film(s).
• House of Ferrera retains authorship, moral rights, and the right to display excerpts for portfolio, exhibition, and archival purposes.
No alteration, re-editing, or derivative works may be created without the written consent of House of Ferrera.
6. Confidentiality & Discretion
All commissions are treated as confidential unless mutually agreed otherwise.
House of Ferrera reserves the right to remain uncredited or discreetly credited, depending on the Patron’s preference.
Discretion is part of the House’s ethos.
7. Fees & Payment
All commissions are secured by a non-refundable creative retainer, with remaining balances payable according to the agreed payment schedule.
Production, travel, talent, and logistical costs are separate and borne by the Patron.
House of Ferrera’s fees cover creative authorship, direction, and cinematic execution only.
8. Cancellations & Rescheduling
If a commission is postponed or cancelled by the Patron, the creative retainer remains non-refundable.
Rescheduling is subject to the House’s availability and may require a new commission agreement.
9. Force Majeure
House of Ferrera shall not be liable for delays or non-performance caused by events beyond reasonable control, including but not limited to weather, political events, transportation failures, illness, or acts of nature.
10. Governing Law
All commissions are governed by Portuguese law, with Madeira as the place of domicile for House of Ferrera and Ava Ferrera.
11. Copyright, Trademark & International Protection
All cinematic works, imagery, written material, and creative assets produced by House of Ferrera are protected under international copyright law, including but not limited to the Berne Convention for the Protection of Literary and Artistic Works.
Ava Ferrera is a registered trademark and remains the exclusive intellectual property of Ava Ferrera, whether used independently or in association with House of Ferrera.
All films, footage, stills, written materials, and creative concepts authored by Ava Ferrera are protected works and remain the intellectual property of the House unless otherwise explicitly licensed in writing.
Commissioning a work grants the Patron a license of use as specified in the agreement — it does not grant ownership of authorship, underlying creative expression, or trademark rights.
No work may be:
• altered
• resold
• sublicensed
• redistributed
• re-edited
• used for AI training
• or used outside the agreed scope
without the express written permission of Ava Ferrera / House of Ferrera.
All rights not explicitly granted are reserved.
Closing Statement
House of Ferrera exists to create cinematic works of lasting cultural and emotional value.
By commissioning the House, the Patron acknowledges and respects its artistic independence, process, and authorship.
